PUNJAB STATE ELECTRICITY REGULATORY COMMISSION

      No. PSERC/Secy./12 - In exercise of the powers conferred by Section 181 (zg) and (zp) read with the provisions of Section 86 (g) and all other powers enabling it in this behalf, the Punjab State Electricity Regulatory Commission hereby makes the following Regulations namely “Punjab State Electricity Regulatory Commission (Fee) Regulations, 2005”.

  1. Short title and commencement
    1. These Regulations may be called the Punjab State Electricity Regulatory Commission (Fee) Regulations, 2005.

    2. These Regulations shall come into force from the date of their publication.

  2. Definitions
      In these Regulations, unless the context otherwise requires :-
    1. “Act” means the Electricity Act, 2003 ;

    2. “Commission” means Punjab State Electricity Regulatory Commission ;

    3. “Chairperson” means Chairperson of the Punjab State Electricity Regulatory Commission ;

    4. “Fee” means fee payable to the Commission as per the provisions of the Act and Rules and Regulations made under the Act ;

    5. “Fund” means Punjab State Electricity Regulatory Commission Fund constituted by the State Government under Section 103 of the Electricity Act, 2003 and till such time designated Bank Account of the Commission;

    6. “Member” means Member of the Punjab State Electricity Regulatory Commission ;

    7. “State Government” means Government of Punjab ;

    8. “Secretary” means Secretary of the Punjab State Electricity Regulatory Commission ;

    9. “Schedule” means schedule of fee appended to these Regulations ;

    10. Words and expressions occurring in these Regulations and not defined herein but defined in the Electricity Act, 2003 shall have the same meaning as in the Act.

  3. Fee on applications / petitions
    1. Every application / petition made to the Commission shall be accompanied by appropriate fees specified in the Schedule to these Regulations.

    2. The fees payable under these Regulations shall be paid into the Fund of the Commission by means of a bank draft or pay order drawn on any Nationalized Bank in favour of Punjab State Electricity Regulatory Commission payable at Chandigarh provided however, amounts less than Rs.500/- (Rupees five hundred only) can be made to the Commission in cash for which duly numbered and signed receipts shall be issued to the depositor.

    3. The depositor shall submit proof of the payment of fee along with application/petition made to the Commission.

    4. The fee received by the Commission, in cash, shall be deposited in the Fund maintained by the Commission in any Nationalized Bank at its headquarters.

  4. Amendment of the Regulations

      The Commission may add, amend, alter or vary any of the provisions of the Regulations and the amount of fee payable as provided in the Schedule to these Regulations by an order to be made by the Commission.

  1. Distribution licensee other than Rural Co-operative Society.



  2. Distribution licensee which is a Rural Co-operative Society.

0.025% of the total revenue receipts for the previous year pertaining to supply area of the licensee payable initially at the time of grant of licence and annually in each subsequent year during validity of the licence, by similar calculation.

Rs.50,000 (Rs. Fifty thousand only) payable initially and annually in each year during validity of the licence.
 c)Undertake trading in electricity as trading licensee.Rs.12.50 lakh (Rs.Twelve lakhs fifty thousand only) payable initially at the time of grant of licence and annual payments of similar amount in each subsequent year during validity of the licence.
3.Fee for grant of exemption from licence and for processing application / petition, for any of the functions mentioned at Sr. No. 2 (a,b,c).Rs.5,000/- (Rs.Five thousand only) payable initially at the time of grant of exemption for each function and annual payments of similar amount in each subsequent year, the exemption remains valid.
4.Fee for review of order on application for grant of licence for transmission, distribution or trading in electricityRs. 50,000/- (Rs. Fifty thousand only) subject to refund in case Review Petition is solely on the ground of error apparent and the same is accepted by the Commission.
5.Petition/ application for grant of permission to a licensee to : 
 a)undertake any transaction to acquire by purchase or take-over or otherwise the utility of any other licensee.As payable for the grant of licence for the function namely transmission, distribution and trading in electricity being acquired, taken-over, merged, assigned or transferred.
 b)to merge his utility with the utility of any other licensee
 c)assign his licence or transfer his utility or any part thereof.
6.Petition / application seeking alteration / amendments in the terms and conditions of licence.Rs.50,000(Rs.Fifty thousand only) payable in lump-sum at the time of filing of petition / application (to be adjusted subsequently against fee on approval of alteration/ amendments).
7.Petition / application for revocation of licence.Rs.1,00,000 (Rs.One lakh only)
8i)Fee for permitting a licensee to use the intervening transmission facilities owned and operated by another licensee and adjudicate upon dispute regarding extent of available surplus capacity.Rs.2,00,000 (Rs.Two lakhs only) for initial period of upto two years and Rs. One lakh for each subsequent year, to be paid in full at the time of application/ petition.
 ii)Fee for fixing rates, charges and terms and conditions for intervening transmission facilities where these are not mutually agreed upon between the parties.Rs.2,00,000 (Rs.Two lakhs only) to be paid in full at the time of application/ petition.
B – Annual Revenue Requirement/Tariff Determination and Power Purchase.
1.Fee for processing ARR/petition for determination of tariff for ; 
 a)supply of electricity by a generating company to a distribution licensee.@ 0.025% of the total revenue receipts in the preceding year.
 b)transmission of electricityRs.5 lakhs (Rs.5 lakhs only)
 c)wheeling of electricityRs.5 lakhs (Rs. Five lakhs only)
 d)Retail sale of electricity@ 0.025% of the total revenue receipts in the preceding year.
2.Fee for petition / application for review of order on ARR / Tariff PetitionRs.50,000 (Rs. Fifty thousand only)
3.Petition /application for approval of power purchase / or procurement process.
  1. Conventional fuel based plant.


  2. Non –conventional and renewable resources of energy including co-generation.



  1. Rs. 10,000/- (Rs.Ten thousand only) per MW or part thereof of the installed capacity subject to a minimum of Rs.One lakh payable at the time of filing of petition / application.
  2. Rs. 5,000/- (Rs.Five thousand only) per MW or part thereof of installed capacity subject to a minimum of Rs. 50,000/-(Rs.Fifty thousand only) payable at the time of filing of petition / application.
4.Fee for review of order on petition for approval of power purchase / procurement process.
  1. Conventional fuel based plant
  2. Non conventional and renewable resources of energy including co-generation



  1. Rs.5,000 (Rs.Five thousand only) per MW subject to a minimum of Rs.50,000/-(Rs.Fifty thousand only).
  2. Rs.2,500/- (Rs.Two thousand five hundred only) per MW subject to a minimum of Rs.25,000/-(Rs.Twenty five thousand only).
Part C Miscellaneous
1.Application for inspection of orders / records of the CommissionRs. 500/- (Rs. Five hundred only) per day.
2.Fees for obtaining certified copies.Rs. 3/- (Rs. Three only) per page subject to a minimum of Rs. 250/- (Rs. Two hundred fifty only).
3.Fee for adjudication upon any difference or dispute regarding payment of compensation by a licenseeTo be fixed on case to case basis depending on the extent of work involved and quantum of claim preferably in the range of Rs.1,000/- (Rs.One thousand only) to Rs. 10000/- (Rs. Ten thousand only)
