ORDER

    The Commission heard the Petitioner for preliminary hearing and admission under Regulation 18 of the Conduct of Business Regulations of the Commission.

  1. The Petitioner pleaded on various points including the necessity for adhoc tariff increase in view of the financial crisis of the Board and the time required for processing the regular Petition of the Board for tariff increase. The Petitioner also pleaded on other points including measures for control of theft etc.

  2. The Commission noted that the Annual Revenue Report and the Tariff Application have already been filed by the Board and the same are under process for passing of orders with the Commission. It was noted that though the Commission is seized of the critical financial position of the Board and is making efforts to pass the tariff order expeditiously, but is bound to follow the due procedure laid down and to undertake public hearing in the matter for which a public notice has already been issued. The Commission also noted that a Petition for Adhoc tariff increase has also been filed by the Board and taken on record of the Commission. The Commission further noted that most of the points raised by the Petitioner are substantively covered under the ARR and Tariff Application of the Board which are being processed by the Commission. The Petitioner is free to make his submissions on various matters in the objections which could be filed by the Petitioner in re! sponse to the public notice already issued inviting objections from public on ARR and Tariff Application. In view of this, the Commission desired to know from the Petitioner whether he was keen to press for the present petition.

  3. The petitioner offered to withdraw the Petition in view of the above position.

  4. Thus the Petition is not pressed and the Commission allows the Petition to be withdrawn.
