ORDER:

    M/S Birla Plus Cement (a Unit of GRASIM INDUSTRIES LIMITED) has filed this petition praying therein that the Sales Regulations No.82.8.2, 82.8.3 and 20.3.1.4 issued by PSEB may be struck down as being arbitrary, unreasonable, illogical and highly injurious to the interest of industry in general and the petitioner in particular. As regards Regulation No.82.8.2 and 82.8.3 the same have been approved by the Commission in the Tariff Order for the year 2005-06, which has been passed after holding public hearing. Now these Regulations can be reviewed only after inviting the public objections and holding public hearings. The petitioner may file objections in respect of these Regulations at that time. The Commission will consider the objections at the time of passing of Order thereon. As regards Regulation No.20.3.1.4, public notice inviting comments from the general public was issued by the Commission in respect of Draft of Punjab State Electricity Regulat! ory Commission (Electricity Supply Code and Related matters) Regulations, 2004 vide public notice published in various news papers on 1.8.2004. Regulation No.20.3.1.4 is one of the subject matters of Punjab State Electricity Regulatory Commission (Electricity Supply Code and Related matters) Regulations. The last date for receipt of comments/objections was 15.9.2004. The petitioner has filed the comments on 10.10.2005 which will be taken up for consideration while approving the Regulations. The petition is, therefore, not maintainable at this stage and is dismissed as such.

    The representative of the petitioner has also stated that copy of the Sales Regulations is not made available by the PSEB for sale or inspection. The PSEB is directed to ensure that the Sales Regulations are made available for inspection to general public and also for sale at a reasonable price.
